I am agreeing to a six-month, non-refundable, non-cancellable commitment. Must cancel 14-days prior to renewal date.

I also agree to a one-time Materials and Setup Fee equal to the cost of one-month of the selected plan.

KDNA™ Program Agreement

By checking this box below, you are agreeing to paying for KDNA™ at the agreed monthly amount. This six-month commitment and program is non-refundable and non-cancellable.

Your monthly payments cover your weekly webinars and your personal KDNA software as defined by your program level. For details on deliverables and timing per your program level, visit https:www.kdna.com and click on the “Learn More” link in your purchased program box.

You agree to allow KDNA™ and Coaches to provide you with Coaching feedback, tools and reminders via Webinars, Email, Phone, Text Messaging and other forms of communication as part of your involvement in the Coaching program.

Prior to completing the first six-month KDNA™ program, you will be notified via email that you will be continued in the KDNA™ program unless you choose to opt-out.

Prior to completing each of these six-month programs, you will be reminded of the ability to opt-out of the next program. To cancel, send your cancellation request via email to support@knowledgedna.com, or by calling the toll-free number: 855-712-4490.

You must cancel 14-days, prior to the automatic renewal date for your next six-month program. If you do not cancel before this timeframe, you will be enrolled into the next six-month commitment which is non-refundable and non-cancellable, and includes all the materials and benefits listed in this Program Fee Agreement.

Client Responsibility: You and all users for whom you are providing payment, accept and agree that all program participants are 100% responsible for their program involvement and results from the program. KDNA and Coaches make no representations, guarantees or warranties verbally or in writing. Program videos, workbooks, coaching input, software, or any other materials are provided to a general real estate clientele and should not be construed and do not intend to provide specific solutions to specific individuals. All program participants are 100% responsible for their own usage of all materials, as well as participation in coaching activities scheduled at the sole discretion of the program. KDNA and Coaches assume no responsibility for omissions or errors that might appear in any program materials, coaching sessions, or software.

Earning and Activity Disclaimer: There is no guarantee that you and all users for whom you are providing payment will earn any income using the techniques and ideas and materials in this program. Examples provided by videos, written materials, coaches, software or otherwise are not to be interpreted as a promise or guarantee of earnings. Potential earnings are entirely determined by those involved in the usage of this program. The level of success by all such parties depends entirely on the commitment and time devoted to the concepts and activities along with knowledge, finances, and skill level. These factors vary by individual, and there are no guaranteed outcomes. Nor are KDNA or the coaches responsible for any of your actions or any actions of those users for whom you are providing payment for this program.

No Distribution of Intellectual Property: KDNA and Coaches’ programs, videos, workbooks and materials are copyrighted and provided to you as a single-user license and for your individual use only. No license to transfer, sell or distribute such materials is implied or granted. You agree not to infringe on any copyrights, trademarks, patents, trade secrets such as coaching procedures or other intellectual property rights. Any such transfer, distribution or sale must first be authorized in writing by KDNA and Coaches. By purchasing this product and programs, you agree that if you violate or appear likely to violate any of these agreements, KDNA and Coaches is entitled via injunctive relief to prohibit such violations.

Limitation of Liability: KDNA and Coaches commit at all times to act in good faith, but results are not guaranteed. In the unlikely event of any dispute arising, KDNA and Coaches liability is limited to the fees paid. IN NO EVENT SHALL KDNA and Coaches BE LIABLE TO CLIENT FOR ANY SPECIAL, PUNITIVE, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND IN CONNECTION WITH THIS AGREEMENT.

Mediation and Arbitration: Any dispute that may arise between the User(s) and KDNA and Coaches in reference to this agreement, or the interpretation, application or construction thereof, and any matter, without limitation, arising out of User(s) involvement with KDNA and Coaches, shall be submitted to mediation using a mediator or mediators and procedures that are mutually acceptable to both parties. If mediation is not successful, the dispute shall be submitted to arbitration, conducted before an arbitrator in Santa Barbara County, California in accordance with the National Rules for the Resolution of Employment Disputes of the American Arbitration Association then in effect. Only individuals who are on the AAA register of arbitrators may be selected as an arbitrator. It is mutually agreed that the written decision of the arbitrator(s) shall be valid, binding, final and non-appealable; provided however, that the parties agree that the arbitrator shall not be empowered to award punitive damages against any party. If for any reason this mediation and arbitration clause becomes not applicable, then each party, to the fullest extent permitted by applicable law, hereby irrevocably waives all right to a trial by jury as to any issue relating hereto in any action, proceeding, or counterclaim arising out of or relating to this Agreement or any other matter involving the parties hereto.

I affirm that I have read and agree to KnowledgeDNA’s terms and conditions and the following statement: I acknowledged that each KDNA™ program requires a six-month commitment which is non-refundable and non-cancellable, and that prior to each subsequent six-month program, I will be notified via email that I will be automatically added to the next six-month subsequent program, unless I choose to opt-out by cancelling at least 14 days, prior to my automatic renewal date by using the email or toll-free phone number listed in this Program Fee Agreement above.
